Re: Proposed New Seed Laws

I have just heard of the proposed new laws and the concerns being expressed by many in Turkey about their potential effects on the millions of people who depend for their livelihoods on agriculture. I hesitate as an outsider to offer any advice although I have worked on a number of agricultural development projects in Turkey over the last 30 years, including the Tarimsal Yayim ve Uygulama Arastirma Projesi (TYUAP) in the 1980s. I have a very strong affection for Turkey and its people, especially those earning their living from the land.

Since I have just heard about this and have not been able to study the details of the proposed laws and am travelling tomorrow, I am not in a position to give detailed comments. I have spent the last 7 years working on the impact of global rules on patents, plant variety protection and other forms of intellectual property. I support the sentiments of the various petitions and objections I have seen on the internet urging you to drop this legislation. I am currently working on a book entitled The future control of food - An essential guide to international negotiations linking intellectual property, biodiversity and the future of food security.

From my understanding of the current proposal, it seems to be very unwise to adopt these laws at present. The issues surrounding them are too great to rush, especially given Turkey's vital position as a centre of genetic diversity. Since the EU membership process will take quite some time, and the need for phased changes during that process, I would urge that they are dropped for now to allow for a much fuller debate about the nature of the farming systems and rural development and opportunities needed in Turkey.

What is clear from my work in recent years is that the rules governing the food system, including those on patents and plant variety protection, increasingly favour the larger firms, often result from their ability to lobby, and gravely threaten the livelihoods of small farmers and future food security. In this case, I strongly suggest you adopt the precautionary principle and do not adopt new seed laws until much nearer the time of EU accession, by which time things may also have changed in Europe in response to the need for reform of the CAP, the diversity and resilience needed to deal with climatic change, and changing global economic conditions.

Konu : Önerilen Yeni Tohum Yasası

Yeni tohum yasasından ve bunun tarımdan  yaşamlarını sağlayan milyonlarca insan üzerindeki potansiyel etkilerine karşı çıkan bir çokları hakkında henüz bilgi sahibi oldum.

Her ne kadar Türkiye'de  1980'lerde Tarımsal Yayım Uygulama Araştırma Projesi (TYUAP) dahil olmak üzere 30 yıllık tarımsal gelişme projeleri deneyimim varsa da dışarıdan biri olarak tavsiyelerde bulunmak konusunda tereddütlüyüm.

Türkiye ve insanlarına özellikle de yaşamını topraktan kazananlara karşı büyük bir sevgi besliyorum.

Bu konu hakkında bilgi sahibi olduğumdan, fakat  önerilen yasanın ayrıntısını yarınki yolculuk planımdan dolayı çalışamadığım için, detaylı yorum yapma pozisyonunda değilim.  Son 7 yılımı, patentler üzerinde küresel kuralların etkisini, bitki çeşitliliğinin korunmasını ve fikri mülkiyetin diğer çeşitlerini çalışmakla geçirdim.

Internette bu yasa tasarısının geri çekilmesine yönelik olarak gördüğüm çeşitli karşı çıkışları ve dilekçeleri destekliyorum. Şu anda " Besinin Gelecekteki Kontrolü- Fikri haklara ilişkin uluslar arası pazarlıklara, biyoçeşitliliğe ve besin güvenliğinin geleceğine ilişkin önemli bir rehber" adlı bir kitap üzerinde çalışmaktayım.

Şu anda gündemde olan söylemlerden çıkarttığım sonuç, yasanın bu şekliyle kabulunun akıllıca olmayacağıdır.Özellikle Türkiye'nin ,genetik çeşitliliğin merkezi konumunda olması , tartışılan maddeleri aceleye getirilmeyecek kadar önemli kılmaktadır.  AB üyelik süreci bir zaman alacağından, bu tartışmalar, Türkiye'nin ihtiyaç duyduğu olanaklar, doğal tarım sistemleri, kırsal gelişim alanları bağlamında daha geniş bir tartışmaya olanak verecek şekilde  daha sonraya bırakılmalıdır düşüncesindeyim.

Son yıllarda yaptığım çalışmalarda ortaya çıkan bulgu; özellikle bitki çeşitliliğinin korunması ve patentler de dahil olmak üzere besin sistemini yöneten kuralların,  genellikle büyük firmalar lehine çıkarılması , büyük firmaların lobi faaliyetleri becerilerine göre sonuçlanması ,böylece küçük çiftçilerin ve gelecekteki besin güvenliğinin tehdit edilmesi şeklindedir. Bu durumda da, önleyici kuralları belirleyip AB katılma süreci yaklaşana kadar yeni tohum yasasını ertelemenizi kuvvetle öneriyorum. Zira bu süreç içinde Avrupada da, CAP reformuna  yönelik ihtiyaçlara cevap verecek değişiklikler, iklim değişikliğiyle başa çıkacak çeşitlilik ve esneklik ve küresel ekonomik koşulların değişimi gibi bir çok şey değişebilecektir.
